OSHA requires the general contractor to have scaffolds and scaffold components inspected for visible defects by a competent person (Scaffold Inspector) prior to each work shift and after any occurrence which could affect a scaffold’s structural integrity. Every employer shall provide information, instructions, training and supervision as may be necessary to ensure, as far as is reasonably practicable, the health and safety at work of his employees.
A scaffold inspection may be the difference between someone’s life and death. If someone is injured or dies because of a scaffolding accident, the company has liabilities as well. Employers failure to provide a safe environment Section 38(2) can lead to conviction and liable to a fine not exceeding R100 000 or to imprisonment for a period not exceeding two years or to both such fine and such imprisonment.
